
On 1 June, a major update to workplace safety laws in Malaysia came into force, signaling a new era for occupational health and safety that affects nearly every workplace in the country.
What changed and why it matters
The updated Occupational Safety and Health (Amendment) Act 2022 (OSHA 2022) broadened the scope of protection under the original Occupational Safety and Health Act 1994 (OSHA 1994, Act 514). The revisions mean that now all places of work throughout Malaysia (with only a few narrow exemptions) are subject to these safety and health regulations not just select industries.
That means offices, retail outlets, service providers, and even public‑service workplaces must now comply a change from the previous limited coverage.
In addition, the law imposes new duties on employers/principals/self-employed persons: they must conduct risk assessments, identify potential hazards, and implement control measures to protect employees’ health and safety.
What employers now must do
Some key obligations under the amended law:
If a workplace has five or more employees, it must appoint a dedicated Safety & Health Coordinator to oversee health & safety compliance.
Employers must perform risk assessments to identify anything from physical hazards to ergonomic and environmental risks and take proactive measures to control or eliminate these risks.
Employees now have the right to remove themselves from imminent danger if the employer fails to act after being informed of the danger. This gives workers a legally protected route to safeguard their own safety.
Stricter enforcement and heavier penalties
The amendments also come with stronger enforcement mechanisms. Employers who fail to comply may face hefty fines (up to RM 500,000), a major increase compared to previous limits.
The aim? To ensure employers treat safety not as a “nice-to-have,” but as a critical obligation. As one industry association put it, workplace safety is “not just a legal requirement, it’s essential for business sustainability.”

Employees / workers:
Familiarise yourself with the updated law, know your rights.
Speak up if you see hazards; safety coordinators have a mandated role under the law.
Retain documentation or evidence if you self‑remove from a dangerous workplace, the law protects you.
Employers / business owners:
Appoint a safety & health coordinator if you have 5+ staff.
Review your workplace for any hazards, physical, environmental, ergonomic, or chemical and document a risk assessment.
Update internal policies, training, and reporting mechanisms to reflect the new legal obligations.
Communicate the changes to all employees so everyone understands their rights and responsibilities.
